GENERAL TERMS AND CONDITIONS OF PURCHASE

1- Object

The present General Terms and Conditions (from now on “Terms and Conditions”) are intended to regulate the conditions of use of the Internet site located at the URLS www.mirelojeria.com, www.newatch.com and www.ceninet.com (from now on “the Site” or “MiRelojeria”), whose holder is the company Relojerías CENI, S.L., with registered office in c/ Ponzano, 4 in Madrid (Spain) and whose social purpose is the compilation, production, marketing and the spreading of information through the Internet as well as the marketing and sale of products.

The mentioned web site has been elaborated, created and designed for Relojerías CENI, S.L., with the aim of announcing and allowing the acces to the contained information, with the restrictions and limitations imposed by the present Terms and Conditions. Its aim as well is to allow and make the acces to other sites, to which the Site has commercial, professional or other relations, possible.

The simple fact of using the site conferes to whom may make use of it the condition of user (from now on “User”), who declares to know and accept any, all and every condition of the Terms and Conditions here exposed without exception.

Through the Site Relojerías CENI, S.L. every user will be provided of the possibility to access to the contents, services and other information concerning the social purpose of the present company. The present Terms and Conditions entirely constitute the agreement between the party what the online transactions of the purchasing and selling between Relojerías Ceni, S.L. and its clients are concerned.

Through the address where the shop is located, any user will have free access to the information contained in the mentioned web site. The access conditions of the Site are subject to the current legal regulations in any moment, as well as to the good faith principles and licit use from the User. Any type of action to the detriment or damage of the Site or third party is specifically and particularly prohibited.
The previous suscription for the simple net navigation, access or use of this service is not required in the Site.

2.2- Content and User Conduct

The Site’s prime objective is to provide with an information service and the distribution of its products and services.
This data base is property of Relojerías CENI, S.L. and contains all the necessary information the client could need, as well as a constant updating of prices, complete technical descriptions, etc. Relojerías CENI, S.L. is exempt from the contents, information, opinions or comments that could be spread through its site, and refuses to accept responsibility of the utilization the user may make of these informations.

3- Rights and Obligations of Relojerías CENI, S.L.

Relojerías CENI, S.L. will only accept responsibility of its rendered services and of the contents which are directly originated through the Site itself and may be identified by its corresponding copyright.

Relojerías CENI, S.L. promises to adopt the necessary means and measures that will ensure the security and privacy of the communications. It will not be held responsible in case the appropriate security measures are violated by extern agents.

4- Prices, Payment, Insurance and Delivery Periods

The prices of MiRelojeria.com do not include VAT. A 16% VAT will be added to any orders made from Spain (except from the Canary Islands, Ceuta and Melilla) and the European Union.

The acquired products will have to be payed after making the order, by sending to Relojerías CENI, S.L. the corresponding amount by any of our payment methods, which are:- credit transfer to any of the bank accounts shown in the informative section of the corresponding web site.
- deposit of the amount at such bank accounts
- VISA or MASTERCARD credit cards through our 3D Secure payment system. In this case, your card will be charged in the very moment of the purchase approval by the payment system.
- cash on delivery (COD): only for deliveries within the European Union. The purchase value will have to be payed by the addressee at the moment of delivery.

The deliveries are made by a urgent 24h transport service, being the maximum delivery period 10 working days since the moment of making the order. If in any case this period shoul be exceeded, Relojerías CENI, S.L. will let the customer know about the incident for him to cancel the order or change the chosen products.

Relojerías CENI, S.L. will insure the ordered products while transported to its destination, and will take on the cost for it, too. Any defect what the products are concerned will have to be informed by the recipient in a reliable way to Relojerías CENI, S.L. within the 15 days after its reception.

5- Warranty

The products’warranties are established by the manufacturers, and therefore it is they who in any case would vouch for the possible faults or defects of the delivered products, as well as for the possible consequences caused by them. The client is obliged to follow the terms and conditions specified in the warranties of the products’manufacturers of the products purchased through MiRelojeria. The warranty is always applied when the product is used under normal running conditions, such as determined by the manufacturers.

6- Returns and Revocation Right

The client has the right to revocate his order without generating any expense, in case the merchandise has not been given to our logistics company yet. Minimum revocation period:
Working days: the revocation period finishes at 17:00h (local time) of the same day, in case the order was made before this time. When ordered afterwards, the revocation period will be extended until 17:00h of the next working day.
Public holiday: the revocation period finishes at 17:00h (local time) of the next working day.

In order to exercise this right the User will have to contact Relojerías CENI, S.L., who will inform him within 24h about the state of is order.

For the return of any product, the client will have to previously contact Relojerías CENI, S.L., indicating his invoice number, and his wish to return the order and send such order carriage paid to the following address:

Relojerías CENI, S.L. will only accept the return of the merchandise if:

1- The client exercises his right of revocation in the 7 days following the delivery of the order. Relojerías CENI, S.L. will accept the exercise of the mentioned right only and exclusively if the merchandise is in the same state as it had been delivered, ready for sale, with its corresponding original package and in perfect conditions, and having fulfilled the requirements established in the delivery section. In this case, Relojerías CENI, S.L. will proceed to reimburse the payed amount to the client, except the postage and packing. In case of orders made within Spain, the postage and packing comes up to 6€. For the rest of orders, the total amount will be reimbursed, with the exception of the postage and packing included in the invoice.

2- The merchandise should be defective: to this respect, Relojerías CENI, S.L. will follow the regulations stipulated in the Defective Products Law, proceeding then to immediately substitute the product for other of identical conditions and provisions. In this case, Relojerías CENI, S.L. will assume the total generated postage and packing.

3- For any attributable cause, the requested product would not correspond with the one requested by the client . In this case, Relojerías CENI, S.L. will assume the total generated postage and packing.

4- Once agreed the return of the payed amount, this return would be made by the same payment system once chosen by the client for the purchase.

7- Copyright

All the contents to which one can access through the service rendered by Relojerías CENI, S.L. are subject of the Copyright and Patent Rights of Relojerías CENI, S.L. and third party. Such contents can not be used, duplicated, distributed, sold, run or any other form with or without commercial purpose, without the previous and preceptive written consent of its owner (Relojerías CENI, S.L.).

Relojerías CENI, S.L. likewise takes responsibility of the brands, logotypes and other distinctive signs that may be included in any part of the Site as property of Relojerías CENI, S.L., as well as of the ownership of any Copyrights or Patents Rights.

Every content and any part of it of the web site MiRelojeria.com has been included according to the good faith principles, with information coming totally or partially from extern sources, therefore MiRelojeria does not take responsibility in any way of the inaccuracy or not updating of the offered contents.

On the contrary, every content coming from intern sources will be properly identified with its copyright. The company reserves the right or faculty to make any change at any moment without prior warning. All the contents included in the site coming from intern sources and that are identified with their own copyright are the only and exclusively responsibility of Relojerías CENI, S.L..

8- Responsibility for Minors

Any purchase in www.mirelojeria.com is only authorized to persons who are legally of age or minors with prior authorization of their parents or tutors.9- Data protectionThe personal data processing is subject to our Privacy Policy.

10- Legal The delivery of the merchandise will be interpreted to all intends and purposes in Madrid, and in any case the affected party, for any matter or difference, will be submitted to the Courts and Judges of this capital, rilinquishing any privilege that could correspond to the client.

11- Commitments

Relojerías CENI, S.L. promises to:

- Verify the correct receipt of the orders for the part of the clients.
- Answer the consultations or reclamations made in a period of less than 24 hours and indicate its possible delay in such a case, calling upon the client to a new estimated period of answer.
- Maintain a system and simple forms for the solution of problems or complaints, accessible by Internet or via e-mail.
- Not making any deceitful publicity. All our commercial information will be rigorous, truthful and contrasted insofar as it is possible and as far as we provide of the necessary means to obtain it.
- Not sending commercial informations without identifying them as such.

The User declares having read, knowing and accepting the present Terms and Conditions to all its extension.
